Importance of the Constitution

Yesterday, the SCOTUS released their ruling on Dobbs vs. Jackson Women's Health. No matter what is being said, this ruling is bad news for Pro-lifers because abortion was not banned and good news for Pro-choicers because abortions are still allowed. IN NO WAY DOES THIS RULING BAN ABORTION, NOR WAS IT EVER INTENDED TO. The Dobbs v. Jackson ruling is 213 pages long and is a very interesting read. It is a lesson in constitutional law and the considerations that must be taken before the court can remove the right of the people, individual states, to create their laws, in order to put those laws in the hands of our federal government. Even though the media and politicians are making this ruling about women's rights, when one reads the ruling, they can see it is solely about the federal government overstepping its boundaries by controlling regulations that belong solely to the states, according to the Constitution. Yesterday, I heard more times than I can count that polls show that people in this nation overwhelmingly support what Roe stood for. If that is the case, this ruling should be a huge win for Pro-choicers, because that overwhelming majority will finally be able to make unrestricted abortion legal in every state and put this question to bed once and for all. Most of the time, the biggest difference between state law and federal law is, in the case of federal law, politicians can claim their laws are for "the good of the people", in state law the actual people make the laws the laws that are good for them through their state representatives, who are chosen locally for the most part. Many said this court is antiquated, but that is exactly what the SCOTUS should be. Their decisions should not be swayed by what is popular today but should only be impacted by the Constitution. The SCOTUS is really there for one reason, to make sure the federal government adheres to those laws allowed it by the Constitution and to prevent the government from taking control of laws that belong to the states, and the people in those states. If you read the ruling you will see that this was not some decision by a bunch misogynistic, bigoted, right wing nut jobs who were trying to exert the will of Donald Trump on the American people, but are Supreme Court justices who understand the importance of the Constitution and having a federal government that has a limited role in our lives and who were willing to seriously evaluate those things considered and not considered, from a constitutional perspective, in order to determine if both Roe and Casey were the right decisions.
