Is There Voter Fraud in PA?

The US Constitution allows state legislatures to pass voter laws in their states. The Constitution is very clear the legislature will be the one passing these laws for the obvious reason of preventing a member of one party from making unilateral decisions concerning voter laws. The Pa. state legislature passed a law, called Voting Act 77, that allowed mail-in voting in addition to absentee voting. This law was passed well before any COVID issues. One important note is the Pa. legislature is controlled by Republicans. There are very specific rules around mail-in ballots, the following are a few of those:

1. The mail-in ballots had to be applied for by a certain deadline. The application wasn't just a request but an application that required a good bit of information and required some effort to fill out.

2. The mail-in ballots had to be physically received before 8pm on election day and postmarks do not count. (Prior to this absentee ballots had to be received by 5pm on the Friday before election day). The deadline was very clearly marked on the application.

3. Those ballots had to include very specific personal information about the voter and it required some type of ID.

4. The mail-in ballots had to be returned in a very specific way. Envelopes had to be stuffed in a certain order, signatures were required and if one was not physically able to sign, a very specific statement was required to give permission for somebody else to sign, that statement required a signature. This is why observers for both parties are necessary, something that was not allowed.

After this legislation was passed the Democratic Governor unilaterally removed the 8pm election day provision, a suit was filed and the Pa. Supreme Court allowed it to stand. Both of these acts were a violation of the US Constitution. The US Supreme Court refused to take up the case because they did not want to be involved in the election and thought that they could avoid it. Justice Alito has said to segregate the ballots that came in after 8pm because he said the plaintiffs have a very viable case. It appears this will, or should, go before the SCOTUS. Unfortunately, if the US Constitution is followed, no ballots received after 8pm should be counted.

Interestingly, 2.5M mail-in ballots were received and the majority of those were Democrat. There are approx. 9M voters in Pa. There have been a little under 7M votes counted in Pa. So 2.5M of those were voters that applied for, received and voted by mail-in ballot. Of those 2.5M, 1.6M were Democrats.

So when you see protestors with professionally made signs that say "Count Every Vote" that means they want every vote counted, whether legal or not. In reality, any vote received after 8pm should not be counted because they are not legal votes.

Why is a deadline important? Because the state legislature did not want to open the door to votes being tallied on election night and all of a sudden one party realizes they are falling behind, stops the count, and brings in a bunch of votes to get those counts up in their favor. Not that anybody would ever do that, right? These laws in Pa. are very reflective of laws in other states that changed to mail-in ballots, so when you hear Trump is just a sore loser, he just needs to concede, and there is no proof of fraud, those statements are just false. Does any of this change the election, who knows? But if there are illegal ballots, and there are, they need to be disqualified. Once that happens, the votes should be certified and a winner declared, but not before then.
